These Terms of Service (“Terms”) govern your access to and use of JSI Racing (“JSI Racing,” “we,” “us,” or “our”) website at www.jsi-racing.com (the “Site”) and any related services, including purchasing products through the Site (collectively, the “Services”). By using the Services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old (or the age of majority in your state) to place an order. By using the Services, you represent that you are legally able to enter into a binding contract.

2. Orders, Pricing, and Payment

• Order acceptance: All orders are subject to acceptance and availability. We may refuse, cancel, or limit orders at our discretion (including suspected fraud, pricing errors, or supply issues).

• Pricing: Prices are shown in U.S. dollars unless stated otherwise. Prices and promotions may change at any time.

• Taxes: Sales tax may be collected where required.

• Payment: You agree to provide current, complete, and accurate payment and billing information.

3. Shipping, Delivery, and Risk of Loss

• Shipping timelines: Estimated delivery dates are not guaranteed.

• Dropship fulfillment: Some products may ship directly from our partner brands/suppliers.

• Risk of loss/title: Risk of loss and title pass to you upon delivery to the carrier, to the extent permitted by law.

• Address accuracy: You are responsible for providing a correct shipping address.

4. Returns, Refunds, and Exchanges

• Return policy: Returns, refunds, and exchanges are governed by our Return Policy (posted on the Site). If there is a conflict, the Return Policy controls.

• Condition: Items must be returned in original condition unless otherwise stated.

• Non-returnable items: Certain items may be final sale or non-returnable (e.g., special orders), as stated on the product page or Return Policy.

5. Product Information and Compatibility

• No install/technical support: JSI Racing sells products only and does not provide installation services or vehicle-specific technical support.

• Fitment/compatibility: You are responsible for confirming product compatibility with your vehicle and intended use before purchase.

• Product descriptions: We try to keep product information accurate, but we do not guarantee that descriptions, images, or specifications are error-free.

6. Performance, Racing, and Off-Road Use Disclaimer

Many automotive products are intended for off-road, track, racing, or show use only and may not be legal for street use in all locations. You are responsible for: - verifying legality and compliance with local/state/federal laws and emissions requirements; - safe installation and use; - any consequences of modifying your vehicle.

7. Warranty Disclaimer and Limitation of Liability

• Manufacturer warranties: Products may be covered by a manufacturer’s warranty. Any warranty claims may need to be handled directly with the manufacturer, unless our Return Policy states otherwise.

• No additional warranties: To the fullest extent permitted by law, the Services and products are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

• Limitation of liability: To the fullest extent permitted by law, JSI Racing will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to the Services or products.

• Cap on liability: To the fullest extent permitted by law, our total liability for any claim will not exceed the amount you paid to JSI Racing for the product(s) giving rise to the claim.

8. User Accounts

• You may need an account to access certain features.

• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

• We may suspend or terminate accounts for violations of these Terms.

9. Prohibited Conduct

You agree not to: - use the Site for unlawful purposes; - attempt to interfere with the Site’s security or operation; - scrape, reverse engineer, or misuse the Site; - submit false, misleading, or fraudulent information.

10. Intellectual Property

All content on the Site (including logos, text, graphics, and design) is owned by JSI Racing or its licensors and is protected by intellectual property laws. You may not use our content without written permission, except as allowed by law.

11. Third-Party Links and Services

The Site may include links to third-party websites or services. We are not responsible for third-party content, policies, or practices.

12. Privacy

Your use of the Services is also governed by our Privacy Policy (posted on the Site).

13. Termination

We may suspend or terminate your access to the Services at any time if we believe you violated these Terms or if necessary to protect the Services.

14. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted on the Site with a new effective date. Your continued use of the Services after changes means you accept the updated Terms.

15. Governing Law and Dispute Resolution

• Governing law: These Terms are governed by the laws of the state where JSI Racing is based, without regard to conflict of law principles.

• Disputes: You agree to attempt to resolve disputes informally first by contacting us. If not resolved, disputes will be handled in a court of competent jurisdiction, unless a separate dispute resolution policy is posted.
